Marriage Requirements in the Philippines between a Philippine and German (Foreign) Citizen



Good Day to all! In this Blog you will know what requirements/steps I have submitted/made when I and my German Spouse were planning to get married in the Philippines. Just click on the links to see the actual papers.

Marriage Requirements in the Philippines between a Philippine/Filipino/Filipina/Pinoy/Pinay and German/
Foreigner/Foreign Citizen

For Widow/Widower:
1. Death Certificate, issued by the Local Civil Registrar's Office
- NSO of deceased husband/wife

- 1 Original Copy and 2 Photocopies
2. CENOMAR (Certificate of No Marriage, issued by the NSO)
- 1 Original Copy and 1 Photocopy
3. Certificate of Attendance, issued by the HRD Office
- 1 Original Copy and 1 Photocopy
4. CEDULA with signature
- 1 Original Copy and 2 Photocopies

For Annulled Marriage:
1. Certificate of Finality of Annulment, issued by the court
- 1 Original Copy and 2 Photocopies
2. Certificate of Registration, from Local Civil Registrar's Office
- 1 Original Copy and 1 Photocopy
3. CENOMAR (Certificate of No Marriage, issued by the NSO)
- 1 Original Copy and 1 Photocopy
4. CEDULA with signature
- 1 Original Copy and 2 Photocopies

For a Foreigner Applicant (German fiancee/fiance):
1. Passport ID
- 2 Photocopies
2. Date of Arrival (Latest), from the passport
- 2 Photocopies
3. Legal Capacity to Contract Marriage

- For details see my other post about “Legal Capacity to Contract Marriage”.
- 1 Original Copy and 3 Photocopies
4. CENOMAR (Certificate of No Marriage, issued by the NSO)

- 1 Original Copy and 1 Photocopy
5. For Divorced applicant
- 1 Original Copy and 2 Photocopies
6. For widow/widower – Death Certificate of deceased
- 1 Original Copy and 2 Photocopies

NOTE:
- Appearance of both applicants is necessary in applying for Marriage license.
- Marriage License will be released after a 10 day posting period.
- At least one of the applicant is a resident of Cebu City(not necessarily from Cebu City).
- Address in the Cedula, Barangay Certificate and Certificate of Attendance must coincide.

- For Naturalized Citizen, bring original and a photocopy of naturalization papers.

Requirements for Marriage License Application
(Filipino fiancee/fiance):
1. Birth Certificate
2. Pre Marriage Counselling Certificate of Attendance, issued by the HRD Office (both Filipino and German)
3. CEDULA with Signature
4. Barangay Certificate
5. CENOMAR (Certificate of No Marriage, issued by the NSO)
6. For ages 18-24, appearance of both parents, with valid ID for parental consent or advice
7. At least one of the applicants is a resident of Cebu City
NOTE: Marriage License will be released after a 10 day posting period

NSO = "National Statistics Office"

These List of Requirements were given to us by the Office of the City Civil Registrar. Not all of the requirements listed here are needed, meaning it depends in YOUR SITUATION. In my situation, I (Filipino) was SINGLE, and my Spouse (German) was SINGLE.

The requirements which have TEXTS IN BOLD above signifies that these were the requirements/steps that I have submitted/made based ON MY EXPERIENCE.

As I read your question, I am assuming these:
- Your German Fiance is coming to Manila
- He is using a Tourist Visa to come to Manila

My Answer:
Of course you and your fiance can marry in Manila using a tourist visa. But keep in mind that he needs to bring other requirements with him. The most important requirement that he needs to bring is the Legal Capacity to Contract Marriage or "Ehefaehigkeitszeugnis" in German.

hello... i went to german embassy with the Ehefähigkeitszeugnis form together with my passport..my fiance said that german embassy here need to sign that form, but they didnt! they said they have nothing to do with it, and i should send it back to my fiance??

Are you sure that the German Embassy just said "they have nothing to do with it"?

I am assuming that the Ehefähigkeitszeugnis you are carrying is in German yet.

What I understand is that Ehefähigkeitszeugnis you are carrying is a paper Owned by your German Fiance. If you submit this document to the Germany Embassy they will not process it as it is not your paper.

In my situation, my German Fiancee went to the Philippines with the Ehefähigkeitszeugnis (still in German Language). Since we are living in Cebu, my German Fiancee just mailed the paper to the German Embassy (with my German Fiancee's name as the sender) to have it checked and translated to English. We received it after 1 week, and then got Married in the Philippines.

In your case you should keep the document with you and wait for your Fiance to arrive in the Philippines. After that, he should be the one to go to the German Embassy to process the paper.

The final Ehefähigkeitszeugnis or Legal Capacity to Contract Marriage looks like this:

Hello Cyrille,

Actually, you should not be the one who fill-up the Ehefähigkeitszeugnis FORM. Your German Fiance should be the one to process this paper in Germany.

Tell your German Fiance he will be the one to process the Ehefähigkeitszeugnis in his Local Civil Registry or "Standesamt" in German.

Also, Please prepare your NSO papers as these will be needed.

I believe that this is an official divorce paper. I don't have a screenshot for this since I am not divorced. I also believe that this paper should be on a NSO Paper.

Do u know what is the other requirements needed that my husband to be submitted? I assume your husband is Malaysian. I believe the Marriage Requirements are just the same as what I have said in this post (For a Foreigner Applicant - German fiancee/fiance or Foreigner).

What you have to secure now that you are still in Malaysia will be the Legal Capacity to Contract Marriage.

Note that you can only be married once in a church. A Sister in Cebu City told me this.

hello, he is a german and im a filipino and we are planning to get married in the philippines the problem is i dont live there(im an OFW) but then im willing to go home at least for 30 days but my fiance cant but then he can be present on the day of applying for marriage license(of course he 's gonna have all the papers h e need) and also can he leave the country after that and then come back on the wedding day.

Hi EGB,

Please do not think that 30 days is enough. For best case, 30 days would be enough, for worst, it could be more. Since you are not in the Philippines right now, I would suggest that you call the Marriage Office at your Province (in Cebu, I and my spouse went to City Health Office as this is the office that cater things about Marriage Requirements and other related stuff.) I would also suggest that you ask help from your relatives or friends so that you can save time and money(long distance call).

Note that there are also seminars or papers which you and your husband are required to be present. The Pre-marriage counselling for example.

With your 30 days, 10 days are already taken due to Marriage notice which will be posted or announced in the church.

I would also suggest that you read this post.

Yes you have to wait for the availability of the judge.

Your civil wedding will be conducted by a judge. You can not choose the judge. The judge's names will be raffled/shuffled on to which couple they will conduct the wedding. This is a new rule. The reason for this new rule is that many marriages before are not legal or are not taking the necessary steps to get married.

Also, please beware of paying high prices under the table for your wedding. Or you might end up like my friend who told me she paid 5,000 to 7,000 Pesos. When I processed my marriage papers, I only paid around 2,000 Pesos or lower.

I am really in need of some information about getting married in the Philippines. I have already sent the required documents to my Philippino fience.(I am a Sri Lankan working in Singpaore in Software industry). My questions are that ,

1. Can she fill up the form in the absense of me ?

2. Also I heard that there is 10 days waiting period. I can actually go there for the 8 hrs sceminar. My problem is that I can not stay in the counrty for 10 days at a strech.is it possible for me to leave the Philippines during those 10 days period and then come back on the Form collection day?

Please help me , I am really very stressed just to find a resource where I get the correct information.

First of all I just want to say that I am no lawyer or consultant regarding wedding or visa papers for that matter. The articles that you can read on my blog are purely based on my experience and ideas.hehe ^_^

Regarding your question, I believe she can fill up the form for you IF and ONLY IF, the process does not need you to be present or does not need your Signature.

I believe it is possible for you to leave the Philippines during those 10 days as all you have to do in these days is just to wait if there are objections to your marriage.

I understand your stressful situation as I was experiencing this before. Waiting outside the City Hall for hours, commuting from one office to office etc...

how long it take for my fiancee to apply for his legal capacity? he is not in Germany at the moment he works abroad. Is it possible that he will apply for this where he is now? (german embassy) or he has to apply in his hometown? thanks

I am very sorry to say that I don't have any experience that is the same with your situation that you are in but here is my experience...

My German spouse processed the Legal Capacity to Contract Marriage at the Local Civil Registry Office (Rathaus in German) and got it after 1 to 2 weeks. The approval from the Rathaus also depends if they have no questions or problems with all the papers your fiance is going to submit.

good day!
i just wanted to get married as simple as possible we been thru a lot of paper works but last minute german authorities find out that one uncorrect spelling on my Birth Certificate (just a day my fiance s Legal capacity will be realeasing) the whole time of my life i been using same middle name including my passport but never see that on BC it was mispelled. my question now is do u think the german authorities will allow the Affidavit of discrepancy with the red ribbon on it? Anyway if they didnt, then the wedding is off because according to him they wont issue the legal capacity of marriage unless my BC is done. Just want to share with u this kind of problems. Any tips that u know?

Based on my experience, getting married in the philippines and get the german visa later is much faster.

As i have read the steps in marrying in cebu and in manila with ur foreinger fiance' it seems very different it looks like that the marriage in province is more complicated.

FYI...The''Capacity to Contract marriage that was brought by ur fiance' needs to submit in German Embassy Manila and this office will only testify that this paper are true and correct but they dont translate it in English bec it was already in german/english translation as u can notice.

First of all I am very thankful to have found this site...It is very helpful to us. By the way, I have a German fiance and we are planning to get married soon. Tanong ko lang po kay Kuya Pinoy in Germany...I am originally from Sibonga, that's a province of Cebu, but I am in Dumaguete right now, it's in Negros Oriental. Now i want to start securing my requirements for "LEGAL CAPACITY TO CONTRACT MARRIAGE'' for my fiance. So should I get all my requirements in Cebu? Like with the CENOMAR and NSO Birth Certificate, can I get those at NSO Dumaguete or do I need to do it in Cebu City? And with the Joint affidavit of civil status and parental advice, should I have it done with a lawyer in town or anywhere else?
And I think with the barangay certificate and Cedula I should get it from my own barangay/town in my homeplace, right?
Pasensya na po. I just wanna be sure with the things I'm gonna do to speed things up...

I am not sure if you can process your papers in Dumaguete because in my experience, I processed all my papers in Cebu. So I think it would be better to ask your local office if you can get these papers.

Thank you po for the reply...I have another question..Were you asked for a baptismal certificate as a requirement? It's not stated in your list but I have read it in some other sites.. I am just a bit worried coz my first name and date of birth that was entered in the baptismal certificate is different with what's in my birth certificate. I used to use with what's in my baptismal certificate. But, after a joint affidavit has been made, I have been using what's in my birth certificate. I hope it won't be a problem.
And by the way, with the authentication of ur passport, did u have to go to DFA Cebu and line up there like when we get a passport or how did you do it?

As far as I can remember, they did not ask me for a baptismal certificate. Only birth certificate. But if you have read it with other sites, then the rules may have already changed.

I think you need to ask the local office regarding your name inconsistency. But better ask first if you really need this baptismal certificate.

Yes I lined up in DFA Cebu for the passport authentication.

To Filipina, u can get Birth Cert. at NSO East Ave. QC. Who needs documents that is translated from english to german? U can get get also ur CENOMAR at NSO office. Where are u both getting married? Legal Capacity to Contract Marriage can get to his rathaus in Germany or where he presently live.

I'm charice, a Filipina with a German fiance.
My fiance wanted me to visit him this July in Germany and get married there. But the problem is that it would take very long before I can get my visa. So, he decided to come here in Philippines on August with his dad for our marriage at the German embassy (Manila) so that I could come with them back to Germany as soon as possible. We had a little problem reagarding the marriage requirements here in the Philippines...but we tried to research on them.
Now, my questions are:
Is it possible that I could come with them right after the wedding?
How long would it take for me to get a spousal visa?

Yes you need to get an appointment (like going to the office first, register... then they will give you a schedule).
For marriage license, it depends if it is required. Better to ask the "marriage" counselor as requirements change from time to time.

I don't know which way is faster as I don't have any experience which I could draw from.

In my experience, I sent my documents to my spouse and get it translated here in Germany.
I believe you can apply a CENOMAR for your German fiance.
For Legal Capacity to Contract Marriage, it would be best to ask a marriage counselor. As I said above, requirements change from time to time.

It's Charice again. Thank you so much for ur reply. I have another questions regarding the marriage requirements. I just wanna confirm if I need to authenticate the CENOMAR and if I can have it authenticated in the DFA Iloilo or really in Manila? My fiance and I discussed about the requirements and he said that I should have my passport authenticated at the German Embassy. Isn't it possible to have it authenticated in the DFA Iloilo?
Can you please tell me more about the marriage requirements 'cause I wanna make everything correct before sending it to my fiance in Germany so that he could get his papers.

Based on my experience, I processed my CENOMAR and put a Red Ribbon on it from DFA Manila. I am not sure if its okay if its from DFA Iloilo. Ask them. For the passport, as far as I can remember the German Embassy will not authenticate passports anymore. Of course this is during the time I processed my papers.

I could not tell you more about the Marriage Requirements since I already wrote everything on this post. There might be updates, so its better to ask the "Marriage Office" directly.

to Mellany of Riyadh, even if u will enter germany using the schengen visa as u said, ur bf needs to ask the rathaus what possible papers/documents u need for the marriage. Its better to prepare in advance so no hassle at all. It depends on the aüslanderbehörde for how long visa they will granted to u in case. Its a case to case basis and every stadt/city have their own RULES to follow as I've heard. I hope this will help u lots..

>I just wanna confirm if I could process my fiance's CENOMAR at NSO? Why do u need to request Cenomar for ur fiance at NSO? who needs it? anyway? He can get certificate of his singlenes in his town where he lives.....you can get your ''CENOMAR'' directly at NSO. no need for red ribbon.

hello charice,for the certification of your passport,u can go to German Embassy and they will authenticate the xerox copy of your passport.U need to pay for that,cant remember how much i paid. :)

hi this is mitch...ask ko lang po during sa pag fill-up ng form sa marriage license or certificate, ano po ba talaga ang dapat sundin if yong name nya has a character of german letter? like ä, ö, etc. Do I need to write it that way? or using ae instead of ä and oe instead of ö?
I know same lang sila ang concern ko lang baka maquestion kung bakit iba yong spelling nila... hope to hear from you ..thanks

No experience with that problem. But if you are getting married here, I believe you have to use ae, oe or ue since the Philippines don't use öüä characters. But again, just my idea...

Hello ichliebedich, based from my experience my husband HAVE it parental consent/advice,but...in the end we didnt need it.My advice for u ichliebedich,u better go to your civil registry (kung san kau magpapakasal) and ask there if u will need it or no. Hope this helps u.

Ich bin Jann. My bf is coming to visit me end of this year for the "traditional" talk between our 2 families (he is bringing his dad along with him on this trip). We plan to have our wed here in PH by late 2011 or early 2012.

I wonder if its advisable to marry in paper first on this coming trip, and have the ceremonies after a year as planned? Would there be a problem foreseen in this type of scenario? I wanted sana na after our wed & pre-honeymoon here in PH ay makakasabay ako sa kanya pag punta sa Germany. He do not have the leisure to wait around for our papers to be processed.

Hallo! My friend did that, also... She came from Bacolod and of course dala-dala pa din niya ang nakaugaliang "TRADITION" natin... But first, she did the Civil Wedding sa Pinas, then they apply it na for Spouse Visa... But, habang naghihintay na din sila ng Approval, they did na yun' Church Wedding at grabe ang bongga... Actually, I'm so amazed sa naging drama ng Lovelife nila... They had their Baby Boy now... So, cute!

@FLOR, yes khit first time kau mag meet pwede na kau ikasal unless you both already prepared the requirements before the day comes. As my experienced i met also 1st time with my husband in Phil. and he brought the documents we need.

@Raissa...you are required to get the Basic German Language in Goethe Inst. eventhough you are a degree holder as i have the same scenario bec that is the main req. in every applicant....FYI in every stadt in DE they have their own rules and regulations to be followed....so if I were you better take this course not bad anyway in order for you to be prepared in any situation that you are going to be encounter when u enter the said country..In addition that if in case ur bf accomplish all the docs/papers in the aüslanderbehörde you both dont have to worry instead just wait the visa to be approve ok...Viel gluck!

I am also from cebu and just got married with my German Fiancee in Hongkong. The Marriage Registry in Hongkong did not ask for the legal capacity to contract marriage. Just want to ask that if I apply for a family unification visa, should we need the legal capacity from the aliens office even if we are married in hongkong already? @anonymous, i think u have a lot things to do, the embassy will ask you for sure some impt. papers eg. annulment paper, certificate of finality, cenomar stating ur name inside on how many times u was married in secpa papers and all documents should be authenticated in Supreme Court then next to DFA for red ribbon...the embassy is very strict when it comes to status of the applicants...OR better send an email to the embassy and ask them about your status they will help you dont worry...

@filipina fr japan, if u are going to get married in PH, the govt. will ask paper from ur fiance eg. legal capacity to get married from his town and u/both need to bring that in their embassy in ph to be authenticated after that submit it to the ofc registrar fr where u are going to marry..that is important to do!

I am Cherrel... me and my fiance are planning to get married here in the Philippines on the 2nd week of february.. his whole family is coming... but, we have this dilemma... in his place, before he can get his certificate of legal capacity to marry, i should submit all the required documents (original and translated into German).. i sent all the required documents in Germany last Sept. 9, 2011.. the officer there checked the papers and approved them.. then the officer said that the documents will be sent to the German Embassy here in Manila for verification...

But, yesterday (november 27) my fiance received an email from their local office that the embassy wanted me to submit additional documents of my addresses and sketch from 15 yrs old up to present and also 2 passport size pictures... they also send an authorization letter to authorize them to verify my documents...

Now, my fiance and I are worried if the Embassy in Manila would be able to give him his certificate of legal capacity to marry... or if they can still give it to him before January 28, 2012 which is their arrival here in the Philippines...

Is there anyone here who have the same experience?

punta ka ng german embassy and then dalhin mo yung passport at yung photocopy ng passport mo..then you need to pay for the stamp or authentication..2 working days before ma release yun poh.thanks.

my german boyfriend will come here in Philippines this august for our first meet,, then we have plan to get married sa 2nd coming niya in october,, gusto niya sna dalhin papers ko pag uwi niya sa germany in august para ma check doon sa germany at makuha niya un legal capacity, ask ko lang po if anu po ung mga papers na e prepare ko? at dapat po ba nka red ribbon lahat?
hopefully someone will answer my question,,, i already made an email to the embassy pero wla pong reply,
another question po pla can i go to german consulate in cebu para magtanong,,?

May itatanong lang po ako meron po akong German boyfriend and gusto po naming magpakasal sa Germany,nag apply po ako ng schengen visa nung May 31 and unfortunately po refuse po ang application ko. ano po kayang maipapayo niyo sa akin na mabilis na proceso ng pagkuha ng visa at mas maganda at madali po ba kung dito kami sa Pilipinas magpapakasal. di po ba ako mahihirapan mag apply ng visa papuntang Germany. sana po matulungan niyo po ako. maraming salamat po.

Hallo po.May tanong lng po ako. Mgbakasyon kmi ng asawa kng german sa pinas ngayong Oktober. May resedence visa naako dto sa germany.Ung passport mgexpired sa March 2014.Makapasok ba ako sa pinas at makabalik ulit dto sa germany?17 days lng kmi sa pinas.Ang passport ko ay 5 mnths before mgexpired.Hnd ba ako ihuhold ng taga IMMEGRATION. Sana masagot nyo po ang tanong ko.Maraming salamat po.

hello I suggest better call the immigration(phillipines manila) habang anjan kapa sa Germany so they will give you some information kung anung step ang gagawin mo..go for it!yan lang masasabi q,baka kasi pagpunta mo dito ehh kailangan ng mahabang panahon ang pagprocess ng mga papers at passport mo.

Ask ko lang po, ang tagal ko na kasing gustong kuhanin yung Bf kong pilipino, divorced na ako sa german husband ko. Bale yung annualled nalang sa pilipinas ang kulang, ngayon po eh, nag german citizen na ako, gusto ko na po syang pakasalan para makuha ko agad dito sa germany ano po ba ang dapat at mabilis na gawin ko, at gawin namin nahihirapan narin po kasi ako, wala naman akong alam sa mas mabilis na paraan para mapakasalan at makuha agad sya.
