What is a Legal Capacity to Contract Marriage (“Ehefähigkeitszeugnis”)?
How to get a Legal Capacity to Contract Marriage (“Ehefähigkeitszeugnis”)?

This paper is issued by their diplomatic official in the Philippines. This is called the “Ehefaehigkeitszeugnis” in German and is available from the Local Civil Registry Office or “Standesamt”. The German fiancee/fiance SHOULD have this document ready before his flight to the Philippines.

" ä "= " ae " in German

The requirements for this document depends on the Local Civil Registry Officer in the local town where the German fiancee/fiance lives. In our case the following papers were asked:

German fiancee/fiance:
1. German Passport
2. Internatonal Birth Certificate

Filipino fiancee/fiance:
1. NSO Birth Certificate with Red Ribbon from the DFA
- Note that in the first page you will see a Red Ribbon, your NSO Birth Certificate is actually on the next page.
2. Joint Affidavit of Civil Status with Red Ribbon from the DFA
- Note that in the first page you will see a Red Ribbon, your Joint Affidavit of Civil Status is actually on the next page.
3. Joint Affidavit of Parental Advice with Red Ribbon from the DFA
- Note that in the first page you will see a Red Ribbon, your Joint Affidavit of Parental Advice is actually on the next page.
4. CENOMAR (Certificate of No Marriage, issued by the NSO)
5. Barangay Certificate
6. Clear Copy of Passport ID with a Certification from the DFA that this is a Certified True Copy


The Filipino fiancee/fiance should submit all documents in Original Copies, unless otherwise stated, per courier to his/her German counterpart.

The German fiancee/fiance should have the documents (from the Filipino fiancee/fiance) Translated to German by a Certified Translator.

DFA = "Department of Foreign Affairs"
NSO = "National Statistics Office"

Note that this paper is a Requirement for Marriage License Application

hello,its me again,cyrille..
the civil registry there where my fiance lives told him, to send to me the application form of Ehefähigkeitszeugnis, fill in where i should fill in(verlobte), bring it to german embassy, and they should sign right beside my signature...civil registry wanted me to do that because i cannot be there for application,they want to make sure i am really the one who signed it...

did u also do this step??

i went there last friday, but they didnt sign it, they said, i should send it back to my fiance..hmmm, may i know from where u are in germany??

Hello Cyrille,

Seems like your situation is different than mine. Where are you planning to get married? In the Philippines or in Germany?

Unfortunately I can't say much of you processing the Ehefähigkeitszeugnis paper.

Our experience:
1. I have mailed all the requirements listed above as a Filipino fiance to my German fiancee.
2. Then my German fiancee processed the Ehefähigkeitszeugnis in her local civil registry in Germany.
3. My German fiancee received the Ehefähigkeitszeugnis paper.
4. My German fiancee went to the Philippines and mailed the Ehefähigkeitszeugnis to the German Embassy to get it checked and translated to english with stamp.
5. We received the Ehefähigkeitszeugnis that is now translated to english (Legal Capacity to Contract Marriage).

Finally, I would suggest you to let your German fiance contact the German Embassy to clarify things because there might be additional requirements for you. It is always case-to-case basis.

By the way, I am living near in Munich.

Hi My name is Lela

I just want to ask if there is a German Embassy in Cebu city? My German fiancee is coming 3 weeks later and i told him already to bring his Legal capacity of contract marriage. He told me that he has it already but not translated in English because the office where he got it told him that he can get his LCOCM in english at German embassy here in PH. I am not a residence of Cebu of Cebu thats why i have no idea if there it is or no. So im hoping that you can help me a bit...

Hi Lela,

Unfortunately there is only one German Embassy in the Philippines and it is located in Makati City.

In my experience, when my German Fiancee arrived in Cebu City, my German Fiancee immediately mailed the Legal Capacity to Contract Marriage (still in German) to the German Embassy in Makati.

After 2 to 3 weeks, we received the Legal Capacity to Contract Marriage paper from the German Embassy and it was already translated to English.

Hello there,
i also have a little problem regarding "getting married in the Philippines"
I am originally from Germany (still German Passport) but i live in the UK for the past nine years. I was married before in germany but i got divorced here in the UK.
When i applied for my "Ehefaehigkeitszeugnis" in germany i have been told that i am "official" still married and i have to legalize my english divorce ?? which takes time ! Stupid we are EU !
Anyway, i have no time for this, so i applied for my "legal capacity to contract marriage" here in the UK and i got it ;-) so i have my german pass, my german birth certificate and my english divorce paper and legal capacity......from the UK
Can anyone confirm that my paperwork are in correct order so i can get finally married in January 2009 !?

Seems like your situation is different than mine.

So your question is If your papers are legal or legitimate. I would suggest that you contact the German Embassy in the Philippines regarding your issue since you are still Officially married in Germany. Just my opinion: I think your papers are correct since you got a Legal Capacity from the UK...BUT...the question is the legality of your marriage or status (I don't know what is the right term for this) in Germany. You better ask or research than going to court.hehe

Hi Anonymous,

I believe you are right. Fiancee requires a lot of time. During my CFO-SMEF-COW Seminar, there was a woman who I talked with. She told me that she already have the German Visa but she waited for 12-14 months. So just be patient and I suggest that you learn German because you really need it. ^_^

because it says here that the papers must have red ribbon from DFA. Do i need to go there in manila?

What I assume are:
1. Your husband's friend wants to get a Legal Capacity to contract Marriage
2. The husband is still working on his Divorce papers.
Am I right?

And also, what do you mean about can he take "it" in the Philippines? What do you mean by "it"?

Hi,

Sorry that I could not directly answer your question because I have no experience regarding this situation which I could draw from.

But IN MY OPINION:
He could not process a Legal Capacity to contract MARRIAGE because he is still legally MARRIED. Maybe after he is LEGALLY DIVORCED.
Again, this is BASED ON MY OPINION.

It would be best that he consults a lawyer in Germany or in the Philippines regarding his situation.

You live near Munich, right? I lived there as well for 3 months (from March to June 2008) almost in the absolute center of the city, it's a beautiful place! ^_^ But you're right, it's expensive to live there ^^;

I want to ask some questions, but maybe just 1 question for now ^^ Did I understand you correctly, that "Ehefähigkeitszeugnis" can be obtained from the local civil registry in Germany and it has to be brought to the embassy here in Manila, (when the fiance arrives) and have it translated into English? Does the embassy here requires other papers? Or do they just translate Ehefähigkeitszeugnis and require nothing else?

I am Filipina and I have a German fiance. Do you know which one is more advantageous: to get married in Philippines or in Germany?

We both wanted to make sure that our marriage will be legitimate in both countries. And to make sure I can go to Germany freely and he can stay in Philippines freely too after we are married. Have any idea?

emm,

It's possible to have a german tourist visa (schengen visa) even if you do not have a relative there. But it's difficult to be granted this visa. First you need a bank account (should be 6 months or more mature) containing I think at least 120K pesos. You should have working certificate, insurance etc.

Yes you are right based on my experience. As for the other papers, please see the list of requirements above for both the German fiancee/fiance and Filipino fiancee/fiance.

As what Anonymous replied, its possible. But you have to be patient as Tourist takes a lot of time before it gets approved. It's not based on experience though, but I heard this from my friends and people I have met when processing my German Spouse Visa.

Personally, I would suggest that you get married in the Philippines because this is my experience ^_^
Of course it will be legitimate in both countries if you follow all the rules and have submitted legitimate papers. And both of you can stay freely either in the Philippines and Germany.

Hello!!!

I wanted to ask again about the other documents required by the embassy...

I thought that German Passport and International Birth Certificate are needed to be passed to the Standesamt in Germany? Should they also be passed to the embassy?

I'm really sorry for being persistent, but I am a bit confused and wants to be sure ^_^

I have another question ^^ Is DFA red ribbon still required? Last July 2007 I had to do this step, but I heard that it is not required anymore by the embassy. Do you have an idea? ^^

As far as I can remember, my German partner passed a German Passport Copy and Internatonal Birth Certificate at the Standesamt in Germany.

My German partner also passed a German Passport Copy, Original Ehefähigkeitszeugnis, Copy of Date of Arrival in the Philippines, and 1250 Pesos payment.

It would also be better if you check the official website of the German Embassy in the Philippines since their requirements always change from time to time. Or contact their local operators if possible. OR let your German partner call the respective office concerned to make everything clear.

Regarding the Red Ribbon, I am not sure if this is still required or not but I submitted my papers with Red Ribbon before. So it would be better to call the German Embassy or let your German partner call the offices concerned. Again, to make things clear as rules always change and German are very STRICT!

Thanks for sharing the info. Then that means the cost is lesser compared before if they removed the DFA Red Ribbon requirement. And it is now easier to get a German Visa if they are after your German Language Certificate.

i just would like to answer ur questions based on my experience.i contacted the german embassy and they have given me a list of the different translation company here in the phils.so its to up to u what company will u choose.then i called one of the companies and they told me to email my birth certificate and cenomar.i paid tru smart money.after 2 days i got the german translation tru a courier.and then i sent it to my husband in germany.

Hello, gusto ko lang sana magtanong kung anong courier maganda magpadala ng documents ko to my fiance in Germany. I need to send kasi yung required docs for his Ehefähigkeitszeugnis, yung mabilis po sana dumating dun sa kanila, kasi yung iba takes months or 3 weeks or 2 weeks, is there any courier na mabilis magpadala mga 1 week? and how much po magpadala sa germany from here in philippines? hello, ask ko lang po sana kung anong courier maganda magpadala ng documents sa germnay, papadla ko kasi yung mga required papers for my fiances Ehefähigkeitszeugnis. gaano po kaya katagal ang aabutin bago nya marecieve and magkano ang shipment fee? thanks.

I used LBC before and it took 1 to 2 weeks. For the price, it depends on the weight of the documents.

Hello! My German fiancee wants me to visit him in Germany, by July after his operation.
He came here in the Philippines 2 times already.We travelled together in Africa last oct.27,2009 for 20 days.But now,his health need him to take rest and he wants me to visit him in Germany.Do you think the visa officer will grant my application,while my annulmnet still on going,and he is widow? I'm afraid the visa officer will not grant me to visit him since Im still married with anothey man,although weve been separated for more than 10 years and no communication at all.My relationship with my german fiancee is already 1 year.Hope you can advise me and help me.Thanks

I believe that you have already answered your own question... "I'm afraid the visa officer will not grant me to visit him since Im still married with another man".
Better to clarify and sort things out. Please be reminded that Germans are very strict.

how many days or week po ba ang pagkuha ng Ehefähigkeitszeugnis sa germany? my german bf don't know yet since he is so busy at work...he told me if i can ask to someone who had been doing this process..he wants to know para ma estimate niya ang time to go at their city hall to the time he will fly here in philippines...or magdepende po ba iyan city by city?

in our experience,it took 2 and a half months.merong madali nakuha,like 3 weeks lang.depende yan sa registrar office ng bf mu kung mahigpit ba sila o hindi.ur bf can ask the officer there also.

i saw in the paper above CERTIFICATE OF LEGAL CAPACITY TO CONTRACT MARRIAGE na this certificate is valid until...
so how many days or months po ba valid ung paper? coz if my fiance cant stay here for more than 10days at pupunta lang xa para maka pag apply kami marriage license. and then he will come back again for marriage.

I have processing my papers that need to send to my bf for him to get his Certificate of No Impediment to Marriage from his Local office in Germany. My questions are:

1. Kapag naipa Red Ribbon ko na mga papers ko and send it to Germany, di na ba nila ibana balik un? Kasi based on my understanding ung mga papers na ipapadla ko sa kanya ay yun din ung mga papers na kailangan namin ipresent sa embassy to get his Legal Capacity to Contract Marriage.

2. Kailangan ba at least 2 copy ko ng mga requirements kapag nagpa RedRibbon ako?

hello anonymous,base sa experience ng asawa ko nung nag apply sya ng legal capacity of contract marriage, binalik naman nila yung mga papers na binigay ko sa kanya.

Legal Capacity to Contract Marriage (makukuha yan ng bf mo sa germany hindi sa embassy sa pilipinas).Pag nasa pilipinas na ang asawa mu, dadalin nya yang paper na yan sa embassy para ipalegalize.and then u need to pay too.

Hello again, thanks for confirmation and enlightening me. I already got my Affidavit of Civil Status, Birth Certificate and Barangay Certificate. Hope this week I could get my CENOMAR and passport certification from dfa so that I can proceed with the next step which is RedRibbon and sending all docs to Germany.

Kung and2 na ung asawa ko at dinala nmin sa embassy yung Legal Capacity to Contract Marriage, how long it would take for us to wait to make it legalize? The same day po ba?

hello poh,kailangan ba talaga na ang Parental advice galing talaga sa judge? tapos ipa notary mo sa RTC? nakakuha kasi ako ng parental advice na form sa city hall tapos nandon na po ang signature ng parents ko, pina notary ko na po then ang kulang nlng is ipa red ribbon...sabi ng kaibigan ko na hnd daw tatanggapin don sa dfa kapag hindi dumaan sa judge at RTC...kahit my notary na po hnd pa ba valid yung parental advice ko?

hello jandre, tama ang kaibigan mo, based also on my experience yan.Pumunta kami sa rtc kung sang city kami nakatira, dinala ko ang document ko sa authenticating department, at sila na ang nag ayos nun, duon na rin ako nagbayad, dadalin nila yan sa judge para tatakan.same day ko rin nakuha, and then pwede mo na yan dalin sa dfa for the red ribbon.

hello poh...iba-iba pala ang requirements para makakuha ng Legal Capacity of marriage yung fiancee mo?Depende pala kung saan cla nakatira sa Germany...they need only original and no need to have red ribbon..But I am worry nung nabasa ko d2 sa blog about sa DFA red ribbon..I am worry baka e reject or ibalik lng nila ang documents ko..ng ask nman ako sa bf ko tapos sabi nya original lng daw...any suggestion or advice??by the way ito pala ang requirements pra makakuha cia ng Legal Capacity of marriage:

Hello! I am Cherrel... me and my fiance are planning to get married here in the Philippines on the 2nd week of february.. his whole family is coming... but, we have this dilemma... in his place, before he can get his certificate of legal capacity to marry, i should submit all the required documents (original and translated into German).. i sent all the required documents in Germany last Sept. 9, 2011.. the officer there checked the papers and approved them.. then the officer said that the documents will be sent to the German Embassy here in Manila for verification...

But, yesterday (november 27) my fiance received an email from their local office that the embassy wanted me to submit additional documents of my addresses and sketch from 15 yrs old up to present and also 2 passport size pictures... they also send an authorization letter to authorize them to verify my documents...

Now, my fiance and I are worried if the Embassy in Manila would be able to give him his certificate of legal capacity to marry... or if they can still give it to him before January 28, 2012 which is their arrival here in the Philippines...

Is there anyone here who have the same experience?

I hope you can give me any idea about the questions that bothers me. I have been to Germany last year to meet my boyfriend there who's that time was only my friend, I am gay, he is also gay and we're both gays. He invited me to visit him last year for just 17 days, as I am still studying in college, since I had no job (kasi nga estudyante ako di ba? kulet?) I used to submit a school certification letter which stating that I am officially enrolled on that semester, August po kasi ako nag-apply and 1st semester po namin yun, and my target dates of stay was October 16 to November 3 which means sembreak lang po talaga ako mawawala, Now, my question is, is the second visa application much easier or more complicated than the first time? If I use again to submit a school certification that I am enrolled in school but will be gone for 90 days, will they consider it as assurance that I will return to my country? my German boyfriend will come with me on my return, maybe presenting our tickets together will help a little, we also have plan to get married, but I don't know if same sex marriage will be honored by the civil registry specially that I'm a foreigner (a Pinoy foreigner) do you know anybody who contracted same sex marriage with a German? thank you so much!

my fiance can't get legal capacity to there Standesamt reason that his birth year appear on his birth cert is incorrect and also on his divorce paper the date is also incorrect.and the ausländer said he would not gett married unless those problem are fix.is the legal capacity is connected to his birth cert?is he really connot get a legal capacity if that's a problem?

Hello, I'm a Filipina and I have a German fiance. At first, we're planning to get married in Germany as soon as possible and get me a fiance visa so I could live with him as early as we can, but as I was scanning all the posts here I think it's better and easier to apply for a Visa for me when we're already married so we kind of had a sudden change of plan. Now, we're trying to follow the same steps the author has made (basically to get married here in the Philippines first then apply for a spousal visa then go to Germany). We're in the first step now which is to get a Legal Capacity of Marriage for him. And I don't know how to get some of the requirements I should send him for the requirements. Please help me. I dont know where to get these two, Joint Affidavit of Civil Status and Joint Affidavit of Parental Advice.
